Dear Club Member

By now, you should have received an email from me with your 2022 invoice attached.  This has been sent using our new “Integrated Management System” computer programme that not only deals with members accounts but also all aspects of maintenance and finance to assist the Resort Manager and staff.  A manager has been identified and I can disclose more about this in future communications.

As this is a new system we expect some teething issues but if we do not get any problems this will be a bonus.  If you have a problem with your invoice please contact us in the usual way, as indicated on the reverse of your invoice.

There are a few Club members that may not have received an invoice.  There are several reasons for this.  Suffice to say that soon I will be in a position to identify those few members and remedy the situation.  This is due to the recent success in the Scottish Courts where FNTC, the Trustee that was dismissed in 2012, has been ordered to hand over the Register of Members to the new Trustee, Hutchinson. We will then see a marked difference in the level of cooperation and communication between the Club Committee and the Trustee that will quickly put Wimpen Onagrup under a level of pressure that it has not felt for the past 10 years. There will be more about this later.

I wrote to you on or around 4 March last year explaining the issues around invoices and the attempt by WimPen Onagrup to collect maintenance fees due for the Club apartments.  I will not repeat all of this.  If you wish to read it again it is on the Club members website.  The main thrust is that WimPen Onagrup has no contract with the Club, and neither WimPen Onagrupnor the DOA (Development Owners Association) act for the Club in any way. 

The Club is governed by a Committee, of which I am Chairman.  The Committee and Club members are governed by the Club Constitution.  The Constitution is a legally binding contract between the member and the Club.  The Committee and the appointed Club Administrator, Hiro Bulchand, are the only bodies that can legally collect fees for the Club apartments.

I am not blind to the fact that Snr Castro and Mr Barrow are saying, pay them or you do not get access to your apartment.  As things stand that is the situation.  This action by them is illegal.  The Club has no fewer than 4 Spanish Court cases pending against Wimpen Onagrup and I can assure you that once the various civil court actions have been finalised I would be surprised if criminal charges are not lodged.

I ask you not to give in to bullying, not to believe the propaganda issued by Snr Castro and Mr Barrow but to support the Club by paying your invoices to the Club.  This may involve short term pain but it will be a longer term gain.  We are entering a crucial stage in this dispute, now is the time to stand together. If you have doubts in your mind, or anything that you are not sure about, it is important that you raise your questions with the Club Committee by replying to this email.
