08 May 2020  – COMMITTEE COMMUNICATION TO MEMBERS ON VE DAY, 8 MAY 2020

We have been informed that information from Mr Castro and Mr Barrow has been made available to Club Members, and in respect of Mr Barrow this information has been disclosed to the general public.  If you receive yet another letter from Mr Castro this will be in breach of the first Arbitration Order by using the Members Register illegally, not having returned the Register to the Committee as instructed.  In this respect the Committee has been forced to take further enforcement action in Spain. It should not have been necessary. Enforcement is only taking place because ONA WimPen continue not to accept the first Arbitration Award ordering the Club’s funds and its Members Register be returned to the Club Chairman.

We are writing to you to advise that the confidentially clause from the Arbitration Rules has been placed on the members’ website https://www.losclavelesowners.eu so that you can make your own judgements.

Club members have been informed by Mr Castro of a second Arbitration.  We cannot disclose any information regarding this as we would be held in contempt of the Arbitration Rules.  What we can tell you is that the Arbitration is ongoing and there is a 28-day period where an appeal can be lodged by any participating party.

Don’t forget the 2016 Arbitration was appealed by WimPen after notifying everyone that they had ‘won’?  At the time we, the Committee said, ‘who in their right mind would appeal if you had won?’  The truth of the matter became clear.  With that in mind all we can suggest is that whatever you hear from Mr Castro or Mr Barrow must be taken with a large pinch of salt.

We cannot over emphasise that Democracy and the views of ordinary members are our priority.  As long as we are the Committee it remains our responsibility to ensure fair play for our Club members despite being handicapped by not having the Club’s membership register.

Our message is very clear.   If you wish to win this battle against an aggressive takeover it is vital that members continue to pay their maintenance fees to the Club in line with their legal responsibility. We are  sorry, this is something that you may not want to hear but those who pay maintenance to Onagrup, a company with no contract, assists their continued presence on the resort despite all our court successes. Please do not let your fellow Club members down.  We can and will win this dispute because we are the ‘owners’.  It is our resort.

Your continued support is deeply appreciated at a time when we are being tested. Your Committee only acts on your behalf and is inspired by you. We need to hold our nerve and stay strong in the spirit of VE Day as Club Member Douglas Goldie says:

On this, the 75th anniversary of VE Day, it makes me think of how all those years ago the free world triumphed over adversary despite the odds being so much against them. Had they believed the propaganda that was being dropped on them and the many untruths being told by their enemies we would have surrendered and history would be so different today.
 

For the last few years a small group of decent honest individuals who recognised a danger to our free existence at Los Claveles rallied support and took on a powerful adversary to save our Club. The odds were against them but with our support the battle has continued. We are being bombarded with propaganda and untruths in order to break our spirit. It will not work. We know from history that if we remain strong, we can win our Club back. If we stick together and continue to believe in our Committee, we can celebrate our own VE Day in the not too distant future.

And, as the Queen said in her VE Day speech, ‘Keep faith. Never give up. Never despair’. We will overcome with your continued support and we will report to you fully when we are legally able to do so.  As always what we will tell you will be THE TRUTH, THE WHOLE TRUTH AND NOTHING BUT THE TRUTH.
